SwiftMed Terms & Conditions

Welcome to SwiftMed. These Terms & Conditions (“Terms”) govern your access to and use of the SwiftMed website, mobile applications, and related technology platform (collectively, the “Platform”).

The Platform is operated by SwiftMed LLC (“SwiftMed,”“we,” “us,” or “our”).

By accessing the Platform, creating an account, requesting transportation, booking a trip, registering as a Transportation Provider, or otherwise using SwiftMed, you acknowledge that you haveread, understood, and agree to these Terms.

1- SWIFTMED’S ROLE

SwiftMed operates a private-pay technology platform and transportation marketplace designedto facilitate connections between passengers and participating transportation providers.

SwiftMed may facilitate transportation requests between passengers and independent transportation companies that provide non-emergency medical transportation.


SwiftMed does not itself provide, own, or operate transportation vehicles and does not itself provide transportation services.

The actual transportation service is provided by the participating Transportation Provider.

SwiftMed’s role is primarily to provide technology that facilitates the request, communication, scheduling, and coordination of transportation services between passengers and participating TransportationProviders.

2- TRANSPORTATION PROVIDERS

Transportation Providers participating on the SwiftMed Platform are independent transportation businesses.


Transportation Providers are responsible for their own:

● Drivers

● Vehicles

● Licenses

● Permits

● Operating authority

● Insurance

● Vehicle inspections

● Driver qualifications

● Training

● Safety procedures

● Transportation operations

● Compliance with applicable laws and regulations.


SwiftMed does not employ the drivers of participating Transportation Providers unless expressly stated in a separate written agreement.

A Transportation Provider’s participation in SwiftMed does not create an employment, agency, partnership, or joint-venture relationship between the Provider and SwiftMed.

3- TRANSPORTATION SERVICES

Depending on location, provider availability, and applicable legal requirements, SwiftMed may facilitate connections for:

Ambulatory Assistance

Transportation for passengers who are able to travel in a seated vehicle but may require assistance getting to or from the vehicle.


Wheelchair Transportation

Transportation for passengers who require a wheelchair-accessible vehicle.

Stretcher Transportation

Non-emergency transportation for passengers who require transportation while remaining on an appropriate stretcher.

Not every Transportation Provider offers every transportation service.

A passenger is responsible for accurately describing their transportation needs when requesting a trip.

4- NON-EMERGENCY TRANSPORTATION ONLY

SwiftMed is intended exclusively for non-emergency transportation.

SwiftMed is not an ambulance service and does not provide emergency medical transportation.


SwiftMed does not provide:

● Emergency medical services

● Medical treatment

● Nursing care

● Medical monitoring

● Medical diagnosis

● Medical advice

● Emergency ambulance transportation.

If you are experiencing a medical emergency, call 911.

5- PRIVATE-PAY PLATFORM

SwiftMed is a 100% private-pay transportation marketplace.

Unless expressly stated otherwise, SwiftMed does not accept Medicare, Medicaid, or private health insurance as payment for transportation services.

Passengers are responsible for paying applicable transportation charges.

Passengers should not assume that transportation requested through SwiftMed will be reimbursed by Medicare, Medicaid, private insurance, or another third-party payer.

6- PASSENGER ACCOUNTS

Certain features of the Platform may require you to create a passenger account.

You agree to provide accurate, current, and complete information.

You are responsible for maintaining the accuracy of your account information and protecting your login credentials.

You must notify SwiftMed promptly if you believe your account has been accessed without authorization.

7- TRANSPORTATION REQUESTS

Passengers may submit transportation requests through the SwiftMed Passenger App or other authorized SwiftMed services.


A transportation request may include:

● Pickup location

● Destination

● Date

● Requested pickup time

● Transportation type

● Mobility requirements

● Passenger information

● Contact information

● Other information necessary to facilitate transportation.

Submitting a request does not necessarily mean that transportation has been confirmed.

A trip becomes confirmed only when the applicable confirmation is provided through the Platform or by an authorized communication from SwiftMed or the Transportation Provider.

8- PROVIDER AVAILABILITY

SwiftMed does not guarantee that a Transportation Provider will be available for every transportation request.


Availability may depend upon:

● Location

● Date and time

● Transportation type

● Vehicle availability

● Driver availability

● Provider service area

● Passenger requirements

● Other operational circumstances.

SwiftMed does not guarantee a particular Transportation Provider, driver, vehicle, pickup time, or transportation outcome.

9- PASSENGER RESPONSIBILITIES

Passengers must provide accurate information regarding their transportation needs.


Passengers are responsible for informing SwiftMed and/or the Transportation Provider of relevant requirements, including when applicable:

● Wheelchair type

● Mobility limitations

● Stretcher requirements

● Assistance requirements

● Number of passengers

● Special equipment

● Pickup instructions

● Other information reasonably necessary to determine whether transportation can safely be provided.

A Transportation Provider may decline or cancel a trip if it determines that it cannot safely or legally accommodate the passenger.

10- TRANSPORTATION PROVIDER RESPONSIBILITIES

The Transportation Provider is responsible for the actual transportation service.


The Provider is responsible for determining whether:

● Its driver is appropriately qualified

● Its vehicle is appropriate

● Required equipment is available

● The passenger can safely be accommodated

● The requested service is within its legal authority

● The trip can be safely completed.

SwiftMed does not independently assume responsibility for these transportation operations.

11- DRIVER AND VEHICLE RELATIONSHIP

Drivers providing transportation through SwiftMed are associated with the participating Transportation Provider responsible for the trip.

SwiftMed does not represent that such drivers are SwiftMed employees.

The Transportation Provider is responsible for its drivers, including applicable hiring, screening, training, supervision, licensing, insurance, and employment or contractor obligations.

The Transportation Provider is also responsible for the vehicles used to provide transportation.

12- TRIP ACCEPTANCE

Transportation Providers are responsible for reviewing transportation requests and determining whether they can safely and legally perform the requested trip.


A Provider should not accept a trip that exceeds its:

● Licensing

● Insurance

● Vehicle capability

● Equipment capability

● Driver qualifications

● Operational capacity.

Once a Provider accepts a trip, it is responsible for making reasonable efforts to perform the transportation as scheduled.

13- CANCELLATIONS

Passengers may cancel transportation requests subject to the SwiftMed Cancellation & Refund Policy and any applicable provider terms.

Transportation Providers are expected to provide reasonable notice when they cannot complete an accepted trip.

Repeated cancellations, no-shows, excessive delays, or failure to perform accepted trips may result in Provider suspension or removal from the SwiftMed Platform.

14- NO-SHOWS

A passenger may be considered a “No-Show” if the passenger is not available at the designated pickup location within the applicable waiting period.

Applicable no-show charges, if any, will be governed by the SwiftMed Cancellation & Refund Policy.

Passengers should contact SwiftMed or the Transportation Provider as soon as possible if they anticipate being late.

15- FARES AND TRANSPORTATION PRICING


Transportation prices may vary depending upon:

● Transportation type

● Distance

● Pickup and destination

● Date and time

● Provider

● Vehicle requirements

● Availability

● Other applicable factors.

Where applicable, pricing information will be displayed before a passenger confirms a transportation request.

Passengers are responsible for reviewing the applicable fare before confirming a trip.

16- PAYMENTS

Passengers may be required to provide valid payment information before transportation can be arranged or completed.

By providing payment information, the passenger authorizes applicable charges associated with the transportation request.

Payment processing may be performed by SwiftMed or an authorized third-party payment processor.

Passengers are responsible for maintaining accurate payment information.

17- CANCELLATION AND REFUND POLICY

Cancellations, refunds, credits, and applicable charges are governed by the SwiftMed Cancellation & Refund Policy.

The Cancellation & Refund Policy is incorporated into these Terms by reference.

Nothing in these Terms eliminates any refund or consumer rights required by applicable law.

18- PASSENGER CONDUCT

Passengers must behave respectfully and lawfully toward Transportation Providers and their drivers.


Passengers may not engage in:

● Violence

● Threatening behavior

● Harassment

● Sexual misconduct

● Discrimination

● Intimidation

● Property damage

● Illegal activity

● Conduct that creates an unreasonable safety risk.

SwiftMed or a Transportation Provider may restrict or terminate transportation services when permitted by applicable law.

19- DRIVER AND PROVIDER CONDUCT

Transportation Providers and their drivers are expected to conduct themselves professionally and respectfully.

Serious complaints involving safety, harassment, discrimination, violence, misconduct, or other unlawful behavior may be investigated by SwiftMed and/or the applicable Transportation Provider.

SwiftMed may suspend or remove a Provider from the Platform when appropriate.

20- INCIDENTS AND ACCIDENTS

Transportation Providers are responsible for responding to accidents, injuries, emergencies, and other incidents occurring during transportation in accordance with applicable law and their ownoperational procedures.

Passengers should immediately contact 911 when an emergency exists.

Passengers may also report incidents to SwiftMed and the applicable Transportation Provider.

To the fullest extent permitted by law, SwiftMed is not responsible for independent acts or omissions of Transportation Providers or their drivers.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

21- PASSENGER INFORMATION

SwiftMed may collect information necessary to facilitate transportation.

This may include personal information and information concerning transportation or mobility needs.

Passenger information may be shared with the applicable Transportation Provider to the extent reasonably necessary to arrange and provide transportation.

SwiftMed’s collection and use of information is governed by the SwiftMed Privacy Policy.

22- PRIVACY AND CONFIDENTIALITY

Users agree to review the SwiftMed Privacy Policy, which explains how SwiftMed collects, uses, stores, and discloses information.

Transportation Providers are separately responsible for complying with applicable privacy and confidentiality requirements concerning passenger information they receive.

23- ACCESSIBILITY

SwiftMed seeks to facilitate access to transportation options for individuals with different mobility needs.

Transportation Providers are responsible for complying with applicable accessibility and nondiscrimination laws governing their transportation operations.

Not every Provider or vehicle will be capable of accommodating every passenger or mobility device.

Passengers should provide accurate information about their transportation needs before booking.

24- THIRD-PARTY SERVICES


SwiftMed may use third-party services to support the Platform, including services for:

● Payment processing

● Mapping

● Communications

● Notifications

● Identity verification

● Background screening

● Hosting

● Other technology functions.

Third-party services may be subject to their own terms and privacy policies.

25- INTELLECTUAL PROPERTY

The SwiftMed name, trademarks, logos, website, mobile applications, software, content, designs, and related technology are owned by or licensed to SwiftMed and are protected by applicable intellectual-propertylaws.

Users may not copy, reproduce, modify, distribute, sell, reverse engineer, or commercially exploit SwiftMed’s intellectual property without prior written permission, except as permitted by law.

26- PROHIBITED USE OF THE PLATFORM


Users may not use SwiftMed to:

● Commit fraud

● Provide false information

● Create unauthorized accounts

● Circumvent applicable fees

● Misuse passenger or Provider information

● Engage in unlawful activity

● Interfere with Platform operations

● Attempt unauthorized access

● Introduce malicious software

● Violate applicable law.

SwiftMed may suspend or terminate accounts involved in prohibited activity.

27- ACCOUNT SUSPENSION OR TERMINATION


SwiftMed may suspend or terminate an account when reasonably necessary due to:

● Violation of these Terms

● Fraudulent activity

● Safety concerns

● Misuse of the Platform

● Repeated payment issues

● Serious complaints

● Regulatory concerns

● Other circumstances permitted by applicable law.

Termination does not eliminate obligations that are intended to survive termination.

28- NO GUARANTEE OF TRANSPORTATION


SwiftMed does not guarantee:

● That transportation will always be available

● That a Provider will accept a request

● That a particular driver or vehicle will be assigned

● That transportation will occur exactly at the requested time

● That a trip will be completed

● That a passenger will receive a particular transportation provider.

Transportation is dependent upon participating Providers and their availability.

29- TECHNOLOGY AVAILABILITY

SwiftMed does not guarantee that the website or applications will always be available, uninterrupted, secure, or error-free.

Temporary interruptions may occur because of maintenance, technical problems, telecommunications failures, third-party services, or circumstances beyond SwiftMed’s reasonable control.

30- DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the SwiftMed Platform is provided on an “as available” basis.

SwiftMed does not warrant that the Platform will be uninterrupted, error-free, or completely secure.

SwiftMed does not guarantee the quality, availability, suitability, safety, or performance of transportation services provided independently by participating Transportation Providers, exceptto the extent required by applicable law.

31- LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, SwiftMed shall not be liable for damages arising from the independent transportation services, acts, omissions, negligence, misconduct, delays,cancellations, vehicle conditions, or driver conduct of participating Transportation Providers.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

32- INDEMNIFICATION

To the fullest extent permitted by applicable law, users agree to indemnify and hold harmless SwiftMed LLC, its owners, officers, employees, agents, and representatives from claims, liabilities,damages, losses, and expenses arising from:

● Violation of these Terms

● Misuse of the Platform

● Fraudulent activity

● Unlawful conduct

● Intentional misconduct

● Violation of another person’s rights.

33- NO MEDICAL ADVICE

SwiftMed does not provide medical advice or determine what type of transportation a passenger medically requires.

Information presented through the Platform is for transportation-related purposes only.

Passengers should consult an appropriate healthcare professional when determining their medical or transportation needs.

34- CHANGES TO THESE TERMS

SwiftMed may update these Terms from time to time.

Updated Terms may be posted on the SwiftMed website or within the mobile applications.

Where required by law, SwiftMed will provide appropriate notice of material changes.

Continued use of the Platform after the effective date of updated Terms constitutes acceptance of the revised Terms to the extent permitted by applicable law.

35- GOVERNING LAW

These Terms shall be interpreted in accordance with applicable federal, state, and local law.

Transportation services may be subject to additional laws and regulations applicable to the jurisdiction in which transportation is provided.

36- SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

37- ENTIRE AGREEMENT

These Terms, together with the SwiftMed Privacy Policy, Passenger Policy & Agreement, Transportation Provider Policy & Agreement, Cancellation & Refund Policy, and other policies expressly incorporatedinto these Terms, constitute the agreement governing your use of the SwiftMed Platform.

38- ELECTRONIC ACCEPTANCE

By creating an account, clicking “I Agree,” “Accept,” “Book Ride,” or another acceptance button, or otherwise using the SwiftMed Platform, you acknowledge that you have reviewed these Termsand agree to be bound by them to the extent permitted by applicable law.
