SwiftMed Passenger Policy & Agreement

This SwiftMed Passenger Policy & Agreement (“Agreement”) governs your use of the SwiftMed website, mobile applications, and transportation marketplace services.

By creating an account, requesting transportation, booking a trip, or otherwise using the SwiftMed platform, you acknowledge that you have read, understood, and agree to this Agreement.

1. ABOUT SWIFTMED

SwiftMed LLC (“SwiftMed,” “we,” “us,” or “our”) operates a technology-enabled, private-pay transportation marketplace.

SwiftMed is designed to connect passengers, patients, family members, caregivers, healthcare facilities, and other authorized users with participating transportation providers offering non-emergencytransportation.


Depending on availability and applicable local requirements, transportation options may include:

● Ambulatory Assistance

● Wheelchair Transportation

● Stretcher Transportation

SwiftMed is a technology platform and does not itself provide, own, or operate transportation vehicles.

Transportation services are provided by independent participating transportation providers.

2. NON-EMERGENCY TRANSPORTATION ONLY

SwiftMed is intended solely for non-emergency transportation.


SwiftMed does not provide:

 

● Emergency ambulance transportation;

● Emergency medical services

● Medical treatment

● Nursing care

● Medical monitoring

● Diagnosis

● Medical advice

● Other emergency healthcare services.

If you are experiencing a medical emergency or require immediate medical attention, call911 or your local emergency medical service.

Do not use the SwiftMed platform for an emergency.

3. TRANSPORTATION SERVICES

SwiftMed may facilitate connections with participating providers offering one or more of the following transportation services.

A. Ambulatory Assistance

Ambulatory assistance is intended for passengers who are able to walk but may require assistance getting to or from a transportation vehicle or navigating to their destination.

Ambulatory assistance does not constitute medical care or nursing services.

Passengers must accurately describe the level of assistance they require when requesting transportation.

B. Wheelchair Transportation

Wheelchair transportation is intended for passengers who require a wheelchair-accessible vehicle.

Passengers should provide accurate information about their wheelchair, including, when applicable:

● Manual or power wheelchair

● Approximate size and weight

● Mobility equipment

● Whether the passenger will remain in the wheelchair during transportation

● Any other information necessary to determine whether the vehicle can safely accommodate the passenger.

The transportation provider is responsible for determining whether it can safely accommodate the passenger and equipment.


C. Stretcher Transportation

Stretcher transportation is intended for passengers who require non-emergency transportation while remaining on an appropriate stretcher.

Stretcher transportation is not emergency ambulance transportation.

Passengers must provide accurate information about their transportation needs so that an appropriately equipped provider can determine whether it can safely perform the trip.

4. PASSENGER RESPONSIBILITY

Passengers and individuals arranging transportation on behalf of a passenger are responsible for providing accurate and complete information.

This may include:

● Passenger name

● Pickup address

● Destination

● Date and time

● Transportation type

● Mobility requirements

● Wheelchair information

● Stretcher requirements

● Assistance requirements

● Contact information

● Other information reasonably necessary to arrange transportation.

Providing inaccurate or incomplete information may result in a provider being unable to safely accommodate the passenger.

5. PASSENGER ELIGIBILITY

The SwiftMed platform is intended for individuals requiring non-emergency transportation.

Passengers must provide truthful information and must not knowingly request transportation under circumstances that exceed the capabilities of the participating transportation provider.

SwiftMed or a participating provider may decline, modify, or cancel a transportation request when the requested transportation cannot safely or legally be provided.

6. ACCOUNT REGISTRATION

Passengers may be required to create an account to use certain SwiftMed features.

You agree to provide accurate, current, and complete information when creating an account.

You are responsible for maintaining the accuracy of your account information.

You must notify SwiftMed if information associated with your account changes.

7. ACCOUNT SECURITY

You are responsible for maintaining the confidentiality of your account credentials.

You should not share your password or account access with unauthorized individuals.

You agree to notify SwiftMed promptly if you believe that your account has been accessed without authorization.

SwiftMed is not responsible for unauthorized use of an account resulting from the passenger’s failure to protect their login credentials, except to the extent otherwise required by law.

8. REQUESTING A RIDE

Passengers may request transportation through the SwiftMed Passenger App or other SwiftMed-approved methods.


When submitting a request, the passenger should provide:

● Pickup location

● Destination

● Date

● Requested pickup time

● Transportation type

●  Passenger information

7. Mobility or accessibility requirements

● Any other information requested by the platform.

Submitting a request does not necessarily guarantee that transportation will be available.

9. TRANSPORTATION AVAILABILITY

SwiftMed does not guarantee that a transportation provider will be available for every request.


Availability may depend upon:

● Geographic location

● Date and time

● Transportation type

● Vehicle availability

● Driver availability

● Provider service area

● Passenger requirements

● Other operational circumstances.

SwiftMed does not guarantee that a particular provider, driver, vehicle, or transportation type will be available.

10. BOOKING CONFIRMATION

A transportation request is not necessarily confirmed merely because it has been submitted through the SwiftMed platform.

Passengers should rely on the confirmation provided through the SwiftMed platform or other authorized communication method.

Passengers are responsible for reviewing their transportation details and promptly reporting any apparent errors.

11. PICKUP RESPONSIBILITIES

Passengers should be ready at the designated pickup location at or before the scheduled pickup time.


Passengers should ensure that:

● The pickup location is accessible

● The transportation provider can safely access the location

● Required mobility equipment is available

● The passenger is ready for transportation

● Any necessary caregiver or attendant is present.

Failure to be ready may result in a delay, cancellation, or no-show charge where applicable.

12. CAREGIVERS AND ATTENDANTS

A passenger may require a caregiver, family member, personal care attendant, or other individual to accompany them.

Passengers are responsible for informing SwiftMed and/or the transportation provider when an additional person will accompany them.

Additional passengers may be subject to vehicle capacity limitations and applicable provider policies.

13. SERVICE ANIMALS

Passengers traveling with a service animal should inform the transportation provider when making a transportation request whenever possible.

Transportation providers must comply with applicable federal, state, and local laws concerning service animals and accessibility.

14. MEDICAL EQUIPMENT AND PERSONAL BELONGINGS

Passengers are responsible for informing the transportation provider about mobility devices, medical equipment, or other items that may affect transportation.

Passengers are responsible for their personal belongings unless otherwise required by applicable law.

SwiftMed is not responsible for lost, damaged, or misplaced personal property except to the extent required by applicable law.

15. PASSENGER CONDUCT

Passengers are expected to behave respectfully and lawfully toward transportation providers and drivers.

Passengers must not engage in:

● Violence

● Threatening behavior

● Harassment

● Discrimination

● Sexual misconduct

● Intimidation

● Property damage

● Illegal activity

● Possession or use of prohibited substances during transportation

● Other conduct that creates an unsafe environment.

A transportation provider may refuse or discontinue transportation when a passenger’s conduct presents a legitimate safety concern, subject to applicable law.

16. DRIVER AND PROVIDER INTERACTIONS

SwiftMed connects passengers with participating transportation providers.

Transportation providers and their drivers are independent from SwiftMed unless otherwise expressly stated in a separate written agreement.

Passengers should treat drivers and transportation personnel respectfully.

Drivers are expected to conduct themselves professionally and comply with applicable laws and provider policies.

17. INCIDENTS INVOLVING PASSENGERS AND DRIVERS

SwiftMed facilitates the connection between passengers and participating transportation providers but does not control the independent conduct of passengers, drivers, or transportation providers.

To the fullest extent permitted by applicable law, SwiftMed is not responsible for independent acts or omissions of passengers, drivers, or transportation providers before, during, or aftertransportation.

Nothing in this Agreement is intended to waive or limit liability that cannot legally be waived or limited.

Passengers should immediately report serious incidents, safety concerns, accidents, injuries, or allegations of misconduct to the appropriate emergency service, law enforcement agency, transportationprovider, and/or SwiftMed, as appropriate.

If there is an immediate emergency, call 911.

18. CANCELLATION POLICY

Passengers may cancel transportation requests subject to SwiftMed’s applicable cancellation policy.


Cancellation fees, where applicable, may depend on:

● Time of cancellation

● Whether the transportation provider has accepted the trip

● Whether the driver has been dispatched

● Distance traveled to the pickup location

● Type of transportation requested

● Other applicable circumstances.

The cancellation and refund terms displayed during booking or contained in SwiftMed’s Cancellation & Refund Policy will apply.

19. NO-SHOW POLICY

A passenger may be considered a no-show if the passenger is not available at the designated pickup location within the applicable waiting period.

A no-show may result in a charge where permitted by the applicable cancellation policy.

Passengers should contact SwiftMed or the transportation provider as soon as possible if they anticipate being late.

20. FARES AND PRICING


Transportation pricing may vary depending on:

● Pickup and destination;

● Distance;

● Transportation type;

● Date and time;

● Provider;

● Availability;

● Vehicle requirements; and

● Other applicable factors.

Where applicable, the passenger will be shown the applicable fare or pricing information before confirming a transportation request.

Passengers are responsible for reviewing applicable pricing before booking.

21. 100% PRIVATE PAY

SwiftMed is a 100% private-pay transportation marketplace.

SwiftMed does not accept Medicare, Medicaid, or private health insurance as payment for transportation services unless expressly stated otherwise.

Passengers are responsible for paying applicable transportation charges.

Passengers should not assume that transportation arranged through SwiftMed will be reimbursed by an insurance company, Medicare, Medicaid, or another third party.

22. PAYMENTS

Passengers agree to provide valid payment information when required.

By submitting payment information, you authorize the applicable payment processor or SwiftMed, as applicable, to process charges associated with your transportation services.

Passengers are responsible for ensuring that their payment information remains accurate and current.

Additional payment terms may be provided through the SwiftMed platform.

23. REFUNDS

Refunds, credits, or adjustments are governed by SwiftMed’s applicable Cancellation & Refund Policy.

A refund is not guaranteed solely because a passenger is dissatisfied with a transportation service.

Claims relating to transportation services provided by an independent transportation provider may also be subject to the provider’s applicable policies and applicable law.

24. PASSENGER INFORMATION

SwiftMed may collect information necessary to facilitate transportation requests.


This may include information such as:

● Name

● Contact information

● Date of birth

● Pickup and destination information

● Transportation requirements

● Mobility information

● Emergency or family contact information

● Payment information

● Other information necessary to provide or facilitate transportation.

SwiftMed’s collection and use of personal information is governed by the SwiftMed Privacy Policy.

By using the platform, you acknowledge that your information may be shared with participating transportation providers to the extent reasonably necessary to facilitate and complete your transportationrequest.

25. ACCURACY OF MEDICAL AND MOBILITY INFORMATION

Passengers are responsible for providing accurate information about their transportation and mobility needs.

SwiftMed and participating transportation providers rely on the information provided by the passenger or the individual arranging transportation.

SwiftMed does not independently diagnose, assess, or medically evaluate passengers.

The transportation provider may decline a request if it determines that the passenger’s needs exceed its available equipment, personnel, licensing, authorization, or ability to safely providethe transportation.

26. NO MEDICAL ADVICE

Information provided through the SwiftMed website or applications is not medical advice.

SwiftMed does not diagnose medical conditions or determine what level of medical transportation a passenger medically requires.

Passengers should consult an appropriate healthcare professional when determining their medical transportation needs.

27. TRANSPORTATION PROVIDER RESPONSIBILITY

Information provided through the SwiftMed website or applications is not medical advice.

SwiftMed does not diagnose medical conditions or deParticipating transportation providers are responsible for providing the actual transportation service.


Providers are responsible for their:

● Drivers

● Vehicles

● Insurance

● Licenses

● Permits

● Training

● Equipment

● Safety procedures

● Transportation operations

● Compliance with applicable laws and regulations.

SwiftMed does not itself operate the transportation vehicle or employ the transportation provider’s drivers unless expressly stated in a separate written agreement.

28. NO GUARANTEE OF PROVIDER PERFORMANCE

SwiftMed does not guarantee that a transportation provider will:

● Arrive at a particular time

● Accept every transportation request

● Complete a trip

● Provide a particular vehicle

● Provide a particular driver

● Meet every passenger preference

● Perform without delay or interruption.

SwiftMed will make reasonable efforts to facilitate transportation requests through the platform but cannot guarantee the independent performance of transportation providers.

29. DELAYS AND CANCELLATIONS


Trasportation may be affected by:

● Traffic

● Weather

● Vehicle problems

● Driver availability

● Road closures

● Passenger circumstances

● Provider scheduling

● Emergencies

● Other unforeseen events.

SwiftMed does not guarantee that transportation will occur exactly at the requested time.

Passengers should allow sufficient time when scheduling transportation for appointments, procedures, surgeries, or other time-sensitive activities.

30. SAFETY AND ACCESSIBILITY

SwiftMed encourages passengers to provide complete and accurate information regarding accessibility and mobility requirements.

Transportation providers are responsible for determining whether they can safely accommodate the passenger.

Passengers should not assume that every participating provider can accommodate every wheelchair, stretcher, medical device, or mobility requirement.

31. PROHIBITED USE

Passengers may not use SwiftMed for:

● Emergency medical transportation

● Illegal activities

● Transportation of prohibited items

● Fraudulent bookings

● False identities

● Harassment of providers or drivers

● Unauthorized commercial use

● Attempts to circumvent applicable fees

● Any purpose prohibited by law or SwiftMed policy.

SwiftMed may suspend or terminate accounts involved in prohibited activity.

32. ACCOUNT SUSPENSION OR TERMINATION

SwiftMed may suspend or terminate a passenger account when reasonably necessary due to:

● Violation of this Agreement

● Fraudulent activity

● Repeated no-shows

● Abusive behavior

● Safety concerns

● Payment disputes or nonpayment

● Misuse of the platform

● Other circumstances permitted by applicable law.

Passengers may also stop using the SwiftMed platform at any time.

33. TECHNOLOGY PLATFORM

SwiftMed does not guarantee that the website or applications will always be:

● Available

● Uninterrupted

● Error-free

● Secure from every possible threat

● Compatible with every device.

Technical problems may affect transportation requests, notifications, communications, or other platform features.

SwiftMed may update, modify, suspend, or discontinue features of the platform from time to time.

34. THIRD-PARTY SERVICES

SwiftMed may use third-party services for payment processing, identity verification, communications, mapping, notifications, background screening, technology infrastructure, or other platformfunctions.

Use of third-party services may be subject to the applicable third party’s terms and privacy policies.

35. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, SwiftMed shall not be responsible for losses, damages, delays, injuries, cancellations, or other consequences arising from the independenttransportation services or conduct of participating transportation providers, drivers, passengers, or third parties.

This limitation does not apply to liabilities that cannot legally be excluded or limited under applicable law.

36. INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless SwiftMed LLC and its owners, officers, employees, agents, and representatives from claims, liabilities,damages, losses, and expenses arising from your:

● Violation of this Agreement

● Misuse of the SwiftMed platform

● Fraudulent activity

● Unlawful conduct

● Intentional misconduct

● Violation of the rights of another person.

This provision applies only to the extent permitted by applicable law.

37. CHANGES TO THIS AGREEMENT

SwiftMed may update this Passenger Policy & Agreement from time to time.

Updated terms may be posted on the SwiftMed website or application.

Where required by law, SwiftMed will provide appropriate notice of material changes.

Your continued use of the SwiftMed platform after the effective date of updated terms constitutes acceptance of the updated Agreement to the extent permitted by law.

38. GOVERNING LAW

This Agreement shall be interpreted and enforced in accordance with applicable federal, state, and local law.

Because transportation requirements may vary by jurisdiction, transportation services are subject to the laws and regulations applicable to the location where transportation is provided.

39. ELECTRONIC ACCEPTANCE

By creating an account, clicking “I Agree,” “Accept,” “Book Ride,” oranother acceptance button, or by otherwise using the SwiftMed platform, you acknowledge that you have had an opportunity to review this Agreement and agree to be bound by its terms to the extent permitted by applicable law.

40. PASSENGER ACKNOWLEDGMENT

By using SwiftMed, I acknowledge and agree that:

 

● SwiftMed is a technology platform and transportation marketplace.

● SwiftMed does not itself provide emergency medical transportation.

● Transportation is provided by independent participating transportation providers.

● I am responsible for providing accurate information regarding my transportation and mobility needs.

●  SwiftMed transportation is 100% private pay unless otherwise expressly stated.

● I understand that Medicare, Medicaid, and private health insurance are not accepted as payment through SwiftMed unless expressly stated.

● Transportation availability is not guaranteed.

● I will not use SwiftMed for emergency medical transportation.

● I have read and agree to the SwiftMed Passenger Policy & Agreement.
