SwiftMed Terms & Conditions
Welcome to SwiftMed, a private-pay non-emergency medical transportation (NEMT) platform. These Terms and Conditions (“Terms”) govern your use of the SwiftMed website, mobile applications, and services (collectively, the “Platform”). By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
1. Platform Overview
SwiftMed is a technology platform that connects users with independent, third-party transportation providers for ambulatory, wheelchair, and stretcher services. SwiftMed does not provide medical care and is not a healthcare provider. All transportation services are provided by independent drivers (“Drivers”), not SwiftMed employees or agents.
2. Private-Pay Services
• SwiftMed is 100% private-pay.
• Users are responsible for all fees associated with services booked through the Platform.
• SwiftMed does not accept insurance, Medicare, Medicaid, or other third-party payments.
• Pricing is displayed upfront and must be paid through the Platform before or at the completion of a ride.
3. User Accounts
To use SwiftMed, you may need to create an account. You agree to:
• Provide accurate and complete information.
• Keep your account credentials secure.
• Notify SwiftMed immediately if your account is compromised.
• Be responsible for all activity under your account.
SwiftMed reserves the right to suspend or terminate accounts for misuse, fraudulent activity, or violation of these Terms.
4. Booking & Cancellation
• Users may book rides on-demand or in advance through the Platform.
• Cancellation policies, fees, and timeframes will be displayed in the app and are subject to change.
• SwiftMed may cancel or reassign rides due to driver availability, safety concerns, or unforeseen circumstances.
5. Independent Drivers
• Drivers are independent contractors, not SwiftMed employees or agents.
• SwiftMed does not control Drivers’ conduct beyond the standards required to participate on the Platform.
• Users acknowledge that SwiftMed does not guarantee the availability, quality, or timeliness of any Driver or service.
6. Safety & Responsibility
• SwiftMed is intended for non-emergency transportation only.
• Users must assess their own ability to use services safely.
• In case of a medical emergency, call 911 immediately.
• Users are responsible for personal belongings and any special equipment needed for transportation.
7. Payments
• All rides must be paid through the Platform using the available payment methods.Drivers must respect the privacy of all passengers.
• SwiftMed uses secure payment processing, but users agree to accept responsibility for payments made from their account.
• Refunds, if any, are issued at SwiftMed’s discretion.
8. Prohibited Conduct
You agree not to:
• Misrepresent yourself or your purpose on the Platform.
• Interfere with the operation or security of the Platform.
• Attempt to book services for illegal purposes or engage in unsafe behavior.
• Share your account with unauthorized users.
9. Intellectual Property
• All content, logos, and materials on the Platform are the property of SwiftMed or its licensors.
• You may not copy, reproduce, distribute, or create derivative works without SwiftMed’s written permission.
10. Privacy
Use of the Platform is also governed by SwiftMed’s Privacy Policy, which explains how we collect, use, and protect your information.
11. Limitation of Responsibility
SwiftMed is a technology platform that connects passengers with independent, third-party drivers. SwiftMed is not responsible or liable for any incidents, injuries, damages, disputes, or losses that may occur between passengers and drivers before, during, or after transportation services. All transportation services are provided by independent drivers who operate at their own discretion and responsibility. By using the SwiftMed platform, you acknowledge and agree that SwiftMed does not control driver conduct and assumes no liability for the actions or omissions of any driver or passenger.
12. Limitation of Liability
To the fullest extent permitted by law, SwiftMed shall not be liable for any direct, indirect, incidental, or consequential damages arising out of or related to any interaction, incident, or dispute between passengers and drivers, whether occurring before, during, or after a ride. All services are provided by independent contractors, and use of the platform is at your own risk.
13. Indemnification
You agree to indemnify and hold harmless SwiftMed, its affiliates, officers, employees, and agents, from any claims, damages, or losses arising from your use of the Platform or violation of these Terms.
14. Modifications
SwiftMed may update these Terms at any time. Updates will be posted on the Platform with a revised effective date. Continued use of the Platform after updates constitutes acceptance of the new Terms.
